-
This Complaints Procedure applies primarily to consumer sales contracts. The rights of a buyer who is not a consumer are governed by the applicable provisions of law and by the agreement between the seller and the buyer.
-
The consumer's rights arising from liability for defects may not be restricted or excluded by this Complaints Procedure.
2. Seller's Liability for Defects
-
The seller is liable to the consumer for any defect that the sold item had at the time of delivery and that becomes apparent within two years from the delivery of the item.
-
In the case of a used item, the seller and the consumer may agree on a shorter period of liability for defects; however, this period may not be shorter than one year from the delivery of the used item.
-
In the case of a used item, a defect resulting from use or normal wear and tear that can reasonably be expected considering the extent of its previous use shall not be considered a defect.
-
If the goods were sold at a lower price due to a specific defect for which the seller is not liable, this fact must have been properly disclosed to the consumer before the conclusion of the sales contract. The consumer may not subsequently exercise rights arising from liability for that specifically disclosed defect.
-
If a defect becomes apparent during the period of liability for defects, it is presumed that the item had the defect at the time of delivery, unless proven otherwise or unless such presumption is incompatible with the nature of the item or the defect.
3. When the Buyer May Assert a Defect
-
The consumer may report a defect that has appeared in the goods within the period prescribed by law.
-
The consumer may exercise rights arising from liability for defects only if the defect is reported within two months from the date on which it was discovered, and no later than the expiry of the period of liability for defects.
-
The consumer may report a defect in person, in writing, or by means of distance communication using the seller's contact details.
-
A defect may be reported in particular:
By post or in person at:
MB Autodiely, s. r. o.
Pravotice 143
956 35 Pravotice
Slovak Republic
By e-mail:
-
When reporting a defect, we recommend providing in particular:
-
the buyer's first and last name / company name,
-
contact details,
-
order or invoice number, if available,
-
identification of the goods being complained about,
-
a detailed description of the defect and its manifestations,
-
the requested method of remedying the defect, if the buyer wishes to specify one.
-
The buyer may provide proof of purchase to demonstrate that the goods were purchased from the seller. However, the seller may not refuse the exercise of rights arising from liability for defects solely because the buyer has not provided a specific type of proof of purchase, if the purchase from the seller can be demonstrated by another means.
4. Confirmation of a Reported Defect
-
The seller shall provide the consumer with written confirmation of the reported defect without undue delay after the defect has been reported.
-
The confirmation shall state, in particular, the period within which the defect will be remedied in accordance with the applicable legal regulations.
-
The period for repairing or replacing the item should generally not exceed 30 days from the date on which the defect was reported.
-
A longer period is possible if there is an objective reason beyond the seller's control. The seller must be able to demonstrate the existence of such an objective reason if necessary.
-
If the seller refuses liability for the defect, the seller shall notify the consumer in writing of the reasons for such refusal.
5. Buyer's Rights in the Event of a Complaint
-
If the seller is liable for a defect, the consumer shall have the right, in particular, to:
-
remedy the defect by repair,
-
remedy the defect by replacement of the item,
-
a reasonable reduction of the purchase price,
-
withdrawal from the sales contract,
to the extent and under the conditions established by law.
-
When remedying a defect, the consumer shall generally have the right to choose between repair of the item and replacement of the item.
-
The consumer may not choose a method of remedying the defect that is impossible or that, compared with the other method of remedying the defect, would impose disproportionate costs on the seller in view of all the circumstances of the case.
-
Before remedying the defect, the seller shall inform the consumer of the right to choose between repair and replacement of the item and shall also inform the consumer of any extension of the period of liability for defects following repair.
-
If the item has been repaired, the period of liability for defects shall be extended by 12 months following the first repair. This extension shall apply only once, regardless of the number of subsequent repairs.
6. Reduction of the Purchase Price and Withdrawal from the Contract
-
The consumer shall have the right to a reasonable reduction of the purchase price or may, under the conditions established by law, withdraw from the sales contract, in particular if:
a) the seller does not repair or replace the item,
b) the seller does not repair or replace the item in accordance with the statutory conditions,
c) the seller refuses to remedy the defect under the conditions established by law,
d) the item has the same defect despite repair or replacement,
e) the defect is of such a serious nature that it justifies an immediate reduction of the purchase price or withdrawal from the contract,
f) it is apparent from the circumstances that the seller will not remedy the defect within a reasonable period or without causing serious inconvenience to the consumer.
-
In the event of withdrawal from the sales contract due to a defect, the applicable provisions of the Civil Code shall apply.
7. Defects Caused by Improper Use or Installation
-
The seller shall not be liable for defects resulting from an act or omission of the buyer after delivery of the goods, in particular if caused by:
a) mechanical damage,
b) improper use of the goods,
c) use of the goods contrary to their intended purpose,
d) failure to comply with the instructions for use or installation,
e) improper assembly or installation, where the seller is not legally responsible for such assembly or installation,
f) incorrect electrical connection,
g) reverse polarity,
h) short circuit,
i) damage caused by electrostatic discharge,
j) overheating or other damage caused by improper handling,
k) improper storage or maintenance,
l) excessive or inappropriate loading,
m) any other use contrary to the manufacturer's documentation or the nature of the goods.
-
If assembly or installation was part of the sales contract and was performed by the seller or under the seller's responsibility, the seller shall also be liable for defects caused by such improper assembly or installation.
-
When assessing a complaint, the seller may require information or documents necessary for an objective assessment of the cause of the defect; however, the seller may not use this requirement to disproportionately restrict the consumer's statutory rights.
8. Spare Parts and Professional Installation
-
For spare parts intended for installation in motor vehicles, the seller recommends that installation be carried out by a professionally qualified person or service centre in accordance with the manufacturer's instructions.
-
When a spare part is subject to a complaint, an expert assessment of the installation method, compatibility of the part, or other circumstances relating to the use of the vehicle may be necessary for an objective assessment of the cause of the defect.
-
The seller may recommend or request the submission of proof of professional installation, particularly for parts where incorrect installation or an incorrect installation procedure may result in damage to the part.
-
Failure to provide proof of professional installation shall not, in itself, automatically result in rejection of the complaint. What is decisive is whether it has been established that the seller is legally liable for the reported defect.
9. Normal Wear and Tear
-
The seller shall not be liable for normal wear and tear corresponding to the nature of the item, its customary method of use, and its expected service life.
-
In the case of used goods, wear and tear corresponding to the extent of their previous use shall not be considered a defect.
-
In the case of goods whose nature involves a limited period of use or a minimum durability period, the seller's liability shall also be assessed with regard to this fact.
10. Complaints Regarding Damage During Transport
-
Upon receiving a shipment, the buyer is advised to inspect the condition of the external packaging and subsequently inspect the goods themselves as soon as possible.
-
If the packaging is visibly damaged upon delivery, we recommend documenting the damage and, where appropriate, reporting it to the carrier.
-
Failure to accept the shipment or signing for the shipment without reservations shall not, in itself, restrict the consumer's statutory rights arising from liability for defects.
-
The consumer's rights arising from liability for defects may not be excluded on the grounds that the buyer did not make a reservation regarding damage to the packaging when accepting the shipment.
11. Costs Associated with a Complaint
-
If the seller is responsible for the reported defect, the consumer shall, under the conditions established by law, have the right to reimbursement of reasonably incurred costs arising in connection with reporting the defect and exercising rights arising from liability for defects.
-
The consumer must claim reimbursement of such costs within the statutory period and demonstrate that the costs were reasonably incurred.
-
When returning goods subject to a complaint, we recommend using an appropriate method of transport and adequately packaging the goods so that they are not further damaged during transport.
-
Goods subject to a complaint do not need to be sent cash on delivery. Shipments sent cash on delivery may be refused by the seller.
12. Complaint Procedure
-
Goods subject to a complaint may be delivered in person or sent to:
MB Autodiely, s. r. o.
Pravotice 143
956 35 Pravotice
Slovak Republic
-
We recommend enclosing the following with the goods subject to a complaint:
-
the order number or a copy of the proof of purchase, if available,
-
the buyer's contact details,
-
a description of the defect,
-
where applicable, a complaint form.
-
The goods must be packaged in such a way as to prevent damage during transport.
-
After receiving the complaint, the seller shall provide the buyer with confirmation of the reported defect and information regarding the further procedure.
-
The seller shall subsequently assess and process the complaint in accordance with the applicable legal regulations.
13. Rejection of a Complaint
-
If the seller concludes that it is not liable for the reported defect, the seller shall notify the consumer of the reasons for refusing liability for the defect.
-
The seller may reject a complaint in particular if it is established that the defect arose after delivery of the goods as a result of improper use, mechanical damage, improper installation, incorrect connection, or another action for which the seller is not legally responsible.
-
A mere assertion by the seller that the goods were improperly installed or used does not constitute a substitute for an objective assessment of the complaint.
14. Special Provisions for Business Customers
-
If the buyer is a person who, when concluding and performing the contract, acts within the scope of their business activities or profession, the purchase contract is not a consumer sales contract.
-
The rights and obligations between the seller and the buyer acting as a business customer shall be governed by the applicable legal regulations and the agreed commercial terms and conditions.
-
Provisions of this Complaints Procedure intended exclusively for consumer protection shall not apply to a business customer to the extent provided for by applicable law or agreed contractual terms.
15. Final Provisions
-
This Complaints Procedure forms an integral part of the Seller's General Terms and Conditions.
-
This Complaints Procedure shall be interpreted in accordance with the applicable laws and regulations of the Slovak Republic.
-
In the event of a conflict between the provisions of this Complaints Procedure and a mandatory provision of law, the applicable legal provision shall prevail.
-
The seller is entitled to amend and update this Complaints Procedure. The version of the Complaints Procedure effective at the time of conclusion of the relevant sales contract shall apply to the specific contractual relationship, unless otherwise provided by law.
